Terms of Service

These Terms of Service ("Terms") are an agreement between you and Brushline LLC, an Oregon limited liability company ("Brushline," "we," or "us"). They cover your use of the Brushline website at https://brushline.io and the Brushline software (together, the "Service"). If you use the Service for a business, you agree to these Terms for that business, and "you" means both you and the business.
By creating an account or using the Service, you agree to these Terms.
1. What Brushline is
Brushline is online software that helps painting businesses estimate jobs, price work to a target margin, track job costs, and review business results. Brushline is a tool to help you make decisions. It does not give legal, tax, accounting, or financial advice. You are responsible for your prices, your estimates, and your business decisions.
2. Your account
- You must be at least 18 and able to enter into a contract.
- Give accurate information and keep it up to date.
- Keep your password safe. You are responsible for activity under your account and the accounts of users you invite.
- Each company account has one owner, who controls billing, users, and the company's data.
- The Service is offered to businesses in the United States.
3. Free trial
New companies get a 5-day free trial with full access. No payment details are needed to start. When the trial ends, the account becomes view-only unless you subscribe. If you don't subscribe, we delete the account and its data 30 days after the trial ends.
4. Subscription, prices, and payment
- The subscription is billed monthly, per company, in US dollars. It costs $99 per month and includes 3 users. Each additional user costs $10 per month. Current prices are always shown on our pricing page.
- Adding or removing users changes your bill automatically. Charges for part of a month are prorated.
- Your subscription renews each month until you cancel. You can cancel at any time from your account settings.
- If we change prices, we will tell you by email at least 30 days before the new price applies to you.
- If a payment fails, we will retry it and let you know. If it still fails, your account may become view-only until payment is made.
Our reseller, Paddle
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns for payments. Paddle calculates, collects, and pays applicable sales tax and similar taxes. Your purchase is also subject to Paddle's buyer terms, which are shown at checkout.
5. Cancelling and refunds
When you cancel, you keep access until the end of the month you've paid for. After that, your account becomes view-only. See our Refund Policy for details on refunds and how long we keep your data.
6. Your data
- You own your data. This includes your company information, customers, estimates, jobs, and any information imported from QuickBooks or other services ("Your Data").
- You give us permission to store, process, and display Your Data only as needed to provide, secure, and improve the Service, and as described in our Privacy Policy.
- You are responsible for having the right to put Your Data into Brushline, including information about your customers and workers.
- You can export Your Data at any time while your account exists.
- We may use anonymous, combined information that cannot identify you or your customers (for example, average job sizes across all users) to improve the Service.
7. Connected services
You may choose to connect other services, such as QuickBooks Online. When you do, you allow us to read and create information in that service as described in the Service. Your use of those services is governed by their own terms. We are not responsible for services we don't control. QuickBooks is a trademark of Intuit Inc.; Brushline is not affiliated with Intuit.
8. AI features
Brushline includes an AI assistant ("Ask Brushline") that answers questions about the Service and explains numbers on your screen. AI answers can be wrong. Check important information before relying on it. The assistant does not change your data.
9. Acceptable use
You agree not to:
- break the law or violate anyone's rights using the Service;
- try to access other companies' data or break our security;
- overload, disrupt, copy, resell, or reverse-engineer the Service;
- upload viruses or harmful code; or
- share your login with people who are not users on your account.
We may suspend accounts that break these rules.
10. Our rights
We own the Service, including its software, design, and content (other than Your Data). If you send us feedback or ideas, we may use them without owing you anything.
11. Changes to the Service and these Terms
We improve Brushline regularly and may add, change, or remove features. If we make an important change to these Terms, we will tell you by email or in the app at least 30 days before it takes effect. Continuing to use the Service after that means you accept the new Terms.
12. Ending your account
You can cancel or delete your account at any time. We may end or suspend your account if you seriously or repeatedly break these Terms, or if we stop offering the Service. If we stop offering the Service, we will give you at least 30 days' notice so you can export Your Data.
13. Disclaimers
The Service is provided "as is" and "as available." We work hard to keep it accurate and available, but we do not promise it will be error-free or always available, or that it will produce any particular business result. Calculations depend on the information you enter. To the fullest extent allowed by law, we disclaim all warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
14. Limit of liability
To the fullest extent allowed by law, Brushline is not liable for lost profits, lost revenue, lost data, or indirect, special, or consequential damages. Our total liability for any claim related to the Service is limited to the amount you paid us in the 12 months before the claim. Some places don't allow these limits, so they may not fully apply to you.
15. Indemnity
If someone makes a claim against us because of Your Data or your misuse of the Service, you agree to cover our reasonable costs of dealing with that claim.
16. Governing law
These Terms are governed by the laws of the State of Oregon, USA, without regard to conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Oregon, unless the law where you are located requires otherwise.
